Daily Picksy — Terms of Service

OVERVIEW

Welcome to Daily Picksy (“Daily Picksy”, “we”, “us”, “our”). We operate this website and store (the “Services”), powered by Shopify. By visiting, interacting with, or using the Services, you agree to these Terms of Service (the “Terms”) and our Privacy Policy (/policies/privacy-policy). If you do not agree, please do not use the Services.

1. ACCESS & ACCOUNT

You represent that you are the age of majority in your place of residence. Information you submit (email, billing, payment, shipping, etc.) must be accurate and complete. You are responsible for safeguarding your account credentials and all activity under your account. Accounts are non-transferable.

2. PRODUCTS & CONTENT

We try to display products accurately, but colors/appearance can vary by device/settings. Descriptions, images, specs, prices, and availability may change without notice. We may limit quantities or discontinue items at our discretion.

3. ORDERS (ALL SALES ARE FINAL)

Placing an order is an offer; we may accept or decline it at our discretion. Payment must be processed before acceptance. Orders are final and generally cannot be cancelled or modified once accepted.

Returns/Refunds: All sales are final. We do not offer returns or exchanges except as required by applicable law (e.g., defective/damaged on arrival). If your item arrives damaged/defective, email support@dailypicksy.com within 7 days of delivery with your order number and photos/video; we’ll assist case-by-case per local law.

Purchases are for personal/household use only, not for resale or export.

4. PRICES, PAYMENTS & BILLING

Prices, discounts, and promotions may change without notice. Unless stated otherwise, prices exclude taxes, shipping/handling, and any customs/import charges. The price in your order confirmation applies. You agree to keep payment details current, are authorized to use the chosen method, and will pay all charges, taxes, and fees.

5. SHIPPING & DELIVERY

Delivery times (e.g., to U.S. addresses) are estimates, not guarantees. We are not liable for delays caused by carriers, customs, or events beyond our control. Title and risk of loss pass to you when the package is handed to the carrier. Any customs/import duties (for non-U.S. shipments) are your responsibility.

6. INTELLECTUAL PROPERTY

All site content (text, images, graphics, audio/video, layout, trademarks, etc.) is owned by Daily Picksy or its licensors and protected by law. Use is limited to personal, non-commercial purposes. No licenses are granted except as expressly stated.

7. OPTIONAL TOOLS & THIRD-PARTY LINKS

We may provide access to third-party tools or links “as is” and “as available,” without warranties or endorsements. Your use is at your own risk and subject to third-party terms/policies.

8. RELATIONSHIP WITH SHOPIFY

Daily Picksy is powered by Shopify. Your sale is with Daily Picksy, not Shopify. By using the Services, you agree Shopify is not responsible for your transactions with us and you release Shopify from any claims arising out of such transactions.

9. PRIVACY

Personal information is handled under our Privacy Policy (/policies/privacy-policy) and may also be processed under Shopify’s privacy terms to operate/improve the Services. Data may be transferred cross-border. See our Privacy Policy for details.

10. FEEDBACK & REVIEWS

If you submit reviews, ideas, or other content (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, and display such Feedback for any purpose. You warrant you have the rights and that your Feedback complies with law and these Terms.

11. ERRORS & OMISSIONS

We may correct errors or update information (including pricing, availability, shipping charges) at any time without prior notice, including after you submit an order.

12. PROHIBITED USES

You may not use the Services for unlawful, infringing, harmful, misleading, or abusive activities; to upload malware; to scrape/harvest data; to bypass security; or to interfere with others’ use. We may suspend or terminate access for violations.

13. TERMINATION

We may suspend or terminate your access at any time at our discretion. Sections that by nature should survive termination will continue (e.g., IP, Feedback, Disclaimers, Liability Limits, Indemnity, Governing Law).

14. DISCLAIMERS

Except as expressly stated by Daily Picksy, the Services and all products are provided “as is” and “as available,” without warranties of any kind, express or implied (including merchantability, fitness, non-infringement, uninterrupted or error-free operation). Some jurisdictions do not allow certain disclaimers; your rights may vary.

15. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Daily Picksy and its affiliates, officers, employees, agents, service providers, and licensors (and Shopify and its affiliates) will not be liable for any indirect, incidental, consequential, special, punitive, or similar damages (including lost profits, revenue, data, or replacement costs) arising from your use of the Services or products, even if advised of the possibility.

16. INDEMNIFICATION

You agree to indemnify and hold harmless Daily Picksy (and Shopify) and our respective affiliates, officers, employees, agents, and service providers from claims, losses, or expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms, violation of law, or misuse of the Services.

17. SEVERABILITY

If any provision is unlawful, void, or unenforceable, the remainder remains in effect to the fullest extent permitted by law.

18. WAIVER & ENTIRE AGREEMENT

A failure to enforce a right is not a waiver. These Terms, together with site policies (e.g., Privacy Policy), constitute the entire agreement and supersede prior understandings relating to the Services.

19. ASSIGNMENT

You may not assign or transfer your rights/obligations without our prior written consent. We may assign or transfer these Terms without notice.

20. GOVERNING LAW & VENUE (U.S.-FOCUSED)

These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-laws rules. You and Daily Picksy consent to the exclusive jurisdiction and venue of the state and federal courts located in Los Angeles County, California.
If you prefer England & Wales, tell us and we’ll switch this section accordingly.

21. CHANGES TO TERMS

You can review the most current version of these Terms on this page. We may update them from time to time; material changes will be notified as required by law. Your continued use of the Services after changes become effective constitutes acceptance.
